General terms and conditions of online sales

This notice contains the legal terms and conditions governing the WWW.PHILHUNT.IT.

By accessing the PHIL HUNT site, users agree to accept and abide by all conditions contained in this statement.

PHIL HUNT reserves the right to temporarily or permanently block the user's account, effective immediately and without notice, in the event that illegal or fraudulent activities are detected. At the same time PHIL HUNT reserves the right to block the account if abnormal uses of the account are detected, including through the use of B.O.T, algorithms and software that may alter or impair the functionality of the site and its services.

PHIL HUNT reserves the right to require that users who do not agree or do not intend to abide by these terms, refrain from using the PHIL HUNT website.

Access to the website and related services is intended for personal use only.

The display of the PHIL HUNT website provides customers with information about the products offered, along with the ability to purchase them.

General Provisions

These conditions apply exclusively between the company PHIL HUNT srl Tax Code and VAT 13484660967 with registered office in MILAN (MI) via VISCONTI di MODRONE UBERTO 2, ZIP CODE 20122 hereinafter referred to as PHIL HUNT and any subject hereafter referred to as CUSTOMER, having the characteristics of "consumer", as defined pursuant to Art. 3, paragraph 1, lett. a) of Legislative Decree 206/2005, who makes online purchases on the website www.philhunt.it in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree 206/2005, as amended by Legislative Decree 21/2014 and Legislative Decree 70/2003 on electronic commerce.

ARTICOLO 1 - Scope of the Agreement

By these general terms and conditions of sale,  PHIL HUNT sells and the CUSTOMER purchases remotely the tangible movable goods indicated and offered for sale on www.philhunt.it. The contract is entered into exclusively through the Internet network, by means of the CUSTOMER accessing www.philhunt.it and placing a purchase order in accordance with the procedure provided by the said site.

The customer undertakes to read, before proceeding, of the confirmation of his order, these general conditions of sale, in particular the pre-contractual information provided by PHIL HUNT and to accept them by ticking the box indicated.

ARTICLE 2 - Pre-contractual information for the consumer - Art. 49 of Legislative Decree 206/2005

The CUSTOMER before entering into the purchase contract, takes note of the characteristics of the goods that are illustrated in the individual product sheets at the time of the choice.

Before the validation of the order with "obligation to pay", the CUSTOMER is informed regarding:

- total price of the goods, including taxes, with details of shipping and any other costs;
- terms of payment;
- expected delivery time for the goods;
- conditions, terms and procedures for exercising the right of withdrawal (Art. 6 of these terms and conditions") as well as the standard withdrawal form;
- possible cost of returning the goods in case of withdrawal;
- existence of the legal guarantee of conformity for the goods purchased;
- conditions of after-sales service provided by PHIL HUNT.

The CUSTOMER may at any time and in any case before entering into the contract, take cognizance of the information about PHIL HUNT, the geographical address, telephone number, e-mail address, information that is provided in brief, below:

PRODUCT SPECIFICATIONS

Only original products are offered for sale on the Site. 

The essential specifications of the products are featured on the Site within each Product tab. The images and colors of the products offered for sale may, however, not correspond to the real ones due to the effect of the Internet browser and/or monitor used by the customer.

Each Product is sold on the Site along with its identification tag, which is an integral part of the actual Product.

ARTICLE 3 - Entry into and effectiveness of the contract

The contract of sale is considered concluded with the sending by PHIL HUNT to the CUSTOMER of an e-mail confirming the order. The email includes the data of the CUSTOMER, the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent, lastly, the link through which to access these conditions that can be retrieved and filed by the CUSTOMER.

The CUSTOMER undertakes to verify the correctness of the personal data contained in the above email and promptly notify PHIL HUNT of any corrections/changes to be made.

PHIL HUNT undertakes to describe and present the items sold on the site in the best way possible. Nevertheless, some errors, inaccuracies or minor differences between the product depicted on the site and the actual product may become apparent. Furthermore, photographs of the products presented on www.philhunt.it do not represent a contractual element,  as they are to be considered representative only.

ARTICLE 4 - Product availability

Product availability refers to the actual availability at the time the CUSTOMER places the order. However, this availability must be deemed purely indicative since:

- products may be sold to other CUSTOMERS prior to order confirmation
- an IT anomaly could occur such that a product is available for purchase that is actually not.

Even after the order confirmation e-mail sent by PHIL HUNT, there may occur cases of partial or total unavailability of the goods. In this eventuality, the order will be rectified automatically with the removal of the unavailable product or products and the CUSTOMER will be immediately informed by e-mail; wth this communication, the customer will also be informed about the methods and timing for the refund of any amounts paid.

ARTICLE 5 - Payment terms

Any payment by the CUSTOMER may only be made by means of the credit cards indicated on the website www.philhunt.it, via PayPal account, via shopify payment.

In case of payment by credit card, the actual charge of the amount of the order will occur only when the order is complete and ready for shipment.

In case of payment by PayPal, the actual charge will take place when PHIL HUNT sends the order confirmation e-mail.

ARTICLE 6 -  Prices

All sales prices of the products shown on the site are in Euro and/or currency and include VAT and any customs charges.

Any discount codes given to the customer cannot be combined and are applied to the full price.

Shipping costs are not included in the purchase price, but are clearly indicated at the completion of the purchase process and before payment is made.

The CUSTOMER accepts the option of PHIL HUNT to change its prices at any time, however, the goods will be invoiced based on the prices indicated on the site at the time of order placement and indicated in the confirmation email sent by PHIL HUNT to the CUSTOMER.

In the event of a computer error, manual, technical, or of any other nature, which may result in a substantial change, not foreseen by PHIL HUNT, in the sale price to the public, making it excessive or clearly too low, the purchase order will be deemed invalid and cancelled and the amount paid by the CUSTOMER will be refunded within 30 days of cancellation.

ARTICLE 7 - Shipping times and costs

PHIL HUNT only accepts orders for delivery within the territory of Italy (excluding Livigno and Campione d'Italia), the Republic of San Marino, the Vatican City State, Switzerland, the United Kingdom and the European Community. Products will be delivered by express courier to the address provided by the CUSTOMER when ordering.

The estimated shipping times are as follows:

Delivery may take an additional day for Calabria and islands.

Free shipping for orders above 500 € free shipping is included

For orders under 500 €, costs vary by destination and will be displayed at checkout.

Orders will be shipped Monday through Friday 9:00 a.m.-12:30 p.m., via MBE courier.

When receiving goods Customers are asked to carefully inspect the package before affixing a signature as proof of delivery of the shipment. Packages are carefully packaged in a box with "WARRANTY SEAL" tape placed around it. Should the package appear tampered with for any reason or if the tape is not intact, customers are asked to sign the receipt with reservation or refuse the delivery. For any irregularities in the package please contact the address info@philhunt.it.

Should the package not be delivered due to factors dependent on the Customer (wrong address,recipient always absent, incorrect telephone number, etc) or if the Customer refuses delivery, the shipping costs and any customs charges will be deducted from the refund due to the Customer.

Shippings where required by specific regulations will be accompanied by the specific fiscal document.

After the shipment has been shipped, the CUSTOMER will receive an e-mail from the courier with the tracking number and a link to monitor the progress of the shipment. In case of delays due to customs offices,  the CUSTOMER will be contacted directly by the courier company or PHIL HUNT.

ARTICLE 8 - Withdrawal rights

In accordance with the legal provisions in force, the CUSTOMER has the right to withdraw from the purchase without any penalty and without specifying the reason, within the period of 14 days from the date of receipt of the products.

The CUSTOMER intending to exercise the right of withdrawal must notify PHIL HUNT by means of an explicit declaration which may be sent by registered letter with return receipt PEC (certified email) or by sending an email to the address: info@philhunt.it. The order number should be specified in the communication.

The CUSTOMER may also exercise the right of withdrawal by sending an explicit statement of the decision to withdraw from the contract using the form below:

In case of exercising the right of withdrawal, the CUSTOMER is obliged to return the goods within 14 days from the day on which he/she communicated to PHIL HUNT his/her wish to withdraw from the contract pursuant to Art. 57 of Legislative Decree 206/2005.

The goods must be returned to the following address: PHIL HUNT viale Cav. Antonio Filograna Z. Industriale Lotto 5 -  73042 Casarano (LE).

The goods must be returned undamaged, unworn, in the original packaging, complete in all its parts (including original box/bag and any documentation and accessory supplies), and complete with the attached tax documentation (if any).

Without prejudice to the right to verify compliance with the above, PHIL HUNT will refund the amount of the products subject to withdrawal, within a maximum period of 30 days.

Returns that do not reflect these characteristics and shipped without additional outer packaging will not be accepted.

As provided by Art. 56 paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, PHIL HUNT may suspend the refund until receipt of the goods or until the CUSTOMER proves to have returned the goods to PHIL HUNT.

PHIL HUNT will make the refund using the same means of payment chosen by the CUSTOMER at the time of purchase. In case of payment made by bank transfer, and if the CUSTOMER intends to exercise his/her right of withdrawal, he/she will have to provide PHIL HUNT, by accessing the section “CONTACT US”, with his/her bank details: IBAN, SWIFT and BIC, necessary to issue the refund by PHIL HUNT.

It is understood that in case of a product defect, shipping costs will be borne by PHIL HUNT in any case.
